Are Dogs Allowed on the Beach in Melbourne Beach, FL?

What the Town of Melbourne Beach and Brevard County codes say about dogs, where leashed dogs can go nearby, and what pet owners should check before buying.

No. Dogs are not allowed on the public beaches or in the public parks of the Town of Melbourne Beach, FL. The town follows Brevard County's animal rules and adds its own ban on domestic animals in town parks and on town beaches, with exceptions for service animals. The closest beach where leashed dogs are welcome is Brevard County's Canova Beach Park in Indian Harbour Beach.

If you are moving to Melbourne Beach with a dog, this question usually comes up on the first walk to the ocean. The rules are clear, and they shape daily life on the south beaches more than most buyers expect. Here is what the town and county codes say, where dogs can go nearby, and what to check in a home before you buy.

What does the Melbourne Beach town code say about dogs on the beach?

The Town of Melbourne Beach Code of Ordinances adopts Brevard County's animal control chapter and amends it so that no domestic animal may enter any public park or beach in the town. Animals also may not be off the owner's property unless they are on a leash and under control.

The town's version of the rule, in Section 35-15 of its code, lists a few exceptions:

  • Dogs trained to assist people with disabilities, while they are doing that work.
  • Dogs working with a law enforcement officer or agency.
  • Animals shown at a limited number of permitted special events approved by the Town Commission.

The town has also reminded residents in its Beach Comber newsletter that it follows the county rule, Brevard County Code Section 14-60, which bars animals from any public park or beach unless an area has been designated for animals and is properly posted. You can read the town's notice in the Town of Melbourne Beach dog ordinance notice and the full text in the Town of Melbourne Beach Code of Ordinances.

Are dogs allowed on the beach south of the town limits?

Generally no. Much of the beach south of the town is unincorporated Brevard County, and the county rule bars animals from public beaches unless an area is designated and posted for them.

The south beaches mix town land, county parks, and state land, and the line between them is not always obvious from the sand. If you are not sure which rules apply at a particular access, look for posted signs at the crossover, and check whether an address is inside the town. My guide to verifying town boundaries and jurisdiction walks through how to do that.

Where is the closest dog beach to Melbourne Beach, FL?

The closest designated dog beach is Canova Beach Park, a Brevard County park at 3299 Highway A1A in Indian Harbour Beach, at the east end of the Eau Gallie Causeway. It is a straight drive north on A1A through Indialantic.

According to Brevard County Parks and Recreation, dogs are welcome on the beach there if they stay on a leash and wear tags showing a current license and vaccinations. There is no cost to use the dog beach, parking is free, and owners must pick up after their pets. The park also has restrooms, outdoor showers, a pavilion, and three dune crossovers, one of them ADA accessible.

Are there off leash dog parks near Melbourne Beach?

Yes. Brevard County's Wickham Park at 2500 Parkway Drive in Melbourne has an off leash dog park divided into small dog and large dog sections. It is on the mainland, so from Melbourne Beach you cross the Indian River on a causeway to get there.

The county's dog park directory lists other county dog parks around Brevard County. Rules such as registration and tag requirements are set by each park, so check the posted rules or call the park before your first visit.

What should dog owners check before buying a home in Melbourne Beach?

Look past the beach and check the rules that come with the property itself. Pet rules in condo and HOA documents, yard and fence details, and walking routes matter more day to day than the beach ban.

  1. Read the condo or HOA documents. Many oceanfront and riverfront condominiums limit the number, size, or type of pets, and some limit pets for tenants. Ask for the current declaration, bylaws, and rules early, before your inspection period runs out.
  2. Check the town's limit on pets at home. Melbourne Beach's code says no one may keep five or more cats, dogs, or a combination of them on a lot or in a living unit, and no dogs or cats may be kept on vacant property.
  3. Look at fence rules and the yard. Fences near the dune, the street, or the right of way can need approvals. My post on fence and right of way review covers what to look for.
  4. Walk the leash route. Since dogs must be leashed off your property, walk the neighborhood streets you would use at the times you would use them, including in summer heat.
  5. Think about vacation rental rules. If you plan to rent the home part of the year, pet policies for guests are your call, but check the town's vacation rental rules and any association rules first.

What is a local take on living in Melbourne Beach with a dog?

From what I see with buyers looking at Melbourne Beach real estate, dog owners are often surprised by the beach ban at first, then plan around it. Some build a routine around early drives to Canova, some favor homes near quieter residential streets for leash walks, and riverside owners often spend more time on the Indian River side of the island. None of that is right or wrong; it depends on how you and your dog like to spend the day.

During sea turtle nesting season, dogs and people both need to stay off the dunes and away from marked nests, including at Canova. If you are curious how turtle season affects homes near the ocean, see my sea turtle lighting property review. Frequently asked questions

Is Melbourne Beach, FL dog friendly?

Dogs are welcome in town on a leash, but they are not allowed on the town's public beaches or in its public parks. Leashed dogs can use the beach at Canova Beach Park in Indian Harbour Beach, a short drive north on A1A.

Can I bring my dog to Ryckman Park or Ocean Avenue Park in Melbourne Beach?

The town code bars domestic animals from every public park in the Town of Melbourne Beach, with exceptions for service animals, law enforcement dogs, and permitted special events. Check posted signs, and contact Town Hall if you have a specific question.

Are service animals allowed on Melbourne Beach beaches?

Yes. Both the town and county rules allow a person with a disability to be accompanied by a service animal on the beach and in parks. Pets and emotional support animals that are not trained service animals are not covered by that exception.

What happens if I take my dog on the beach in Melbourne Beach?

Bringing a dog onto a public beach or park in the town is a violation of the town's animal ordinance, and the owner can be cited. Penalties are set by the county and town codes, so the simplest choice is to use a designated dog beach.
